• Voice Clips: Used for our Voice Moderation Systems. Can be viewed by Phoenic Analytics if a violation was found.

These Terms of Service ("Terms") govern your access to and use of the game Colobus ("the Game") and https://discord.gg/Z7AZuquvbX ("the Discord Server") operated by Phoenic Analytics ("we," "our," or "us"). By downloading, accessing, using Colobus, or Joining/Chatting in the Discord Server, you agree to be bound by these Terms. If you do not agree, you may not access the Discord Server or use the Game.

By installing, launching, or interacting with the Game or its services, you are deemed to have accepted these Terms, even if a direct agreement screen is bypassed or removed.

Tampering with or removing this agreement does not waive any rights held by the copyright owner, Phoenic Analytics. Unauthorized modification or redistribution of this software is strictly prohibited and will be pursued under applicable law.

Players may report violations or abuse in game or by using the Discord “#⚠️-reports” Channel. We review all reports and may take action at our own discretion.

1. Eligibility

You must be at least 13 years old to play Colobus. If you are under 18, you must have permission from a parent or legal guardian to use the Game. By using the Game, you represent that you meet these requirements.

2. Accounts

Some features of Colobus may require creating an account through PlayFab or another third-party service. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized access or use of your account.

3. Restrictions

You agree to use Colobus only for lawful purposes and in accordance with these Terms. You must not:

• Use spam, or exploit webhooks, API, or any 3rd party services (such as Discord, or PlayFab) in connection with the game in any abusive, automated, malicious or disruptive manner.
• Attempt to bypass, disable, or interfere with Discord server protections, moderation tools, or reports.
• Engage in denial-of-service attacks, flood requests, or mass automation intended to overload or interfere with Discord servers, PlayFab or any other backend infrastructure used by Colobus.
• Reverse engineer, decompile, disassemble, or extract/use any source code of Colobus.
• Modify, cheat, exploit, or create unauthorized tools or hacks for Colobus.
• Circumvent any technical protection measures or security mechanisms for Colobus.
• Use the game for commercial purposes without written permission from Phoenic Analytics.
• Use automation, bots, or scripts to gain unfair advantage for Colobus.
• You may not use the Game, its assets, or systems for commercial purposes (including paid mods, hosting, or access) without prior written permission from Phoenic Analytics Analytics.

3.1. Threats, Harassment, and Coercion

You are strictly prohibited from engaging in:

• Threats, harassment, or intimidation of the developer (Phoenic Analytics), any staff, or other players for any reason.
• Blackmail or coercion, such as pressuring the developer to ban/unban players, alter the game, give special items/currency, or make moderation decisions under threat.
• Disruptive conduct, including threats to leak personal information, release exploits, crash servers, hack/exploit, or interfere with the game's operations or community. Any such behavior is grounds for immediate ban and potential legal action.

4. Player-to-Player Voice Chat

Colobus includes real-time voice chat functionality for player-to-player communication. By using this feature, you agree to:

• Communicate respectfully and avoid harassment, hate speech, discrimination, or explicit content.
• Refrain from sharing personal information, including addresses, passwords, or financial details.
• Acknowledge that voice data may be processed by third-party services (such as Photon Voice) to enable real-time communication.
• Understand that we monitor and/or record every voice chat session and may review reports of misconduct in accordance with applicable laws.

We reserve the right to suspend or permanently ban players who misuse the voice chat system or violate community standards.

5. Ownership and Intellectual Property

All rights, title, and interest in Colobus, including all software, graphics, assets, audio, text, and code, are owned or licensed by Phoenic Analytics. You are granted a limited, non-exclusive, non-transferable license to play the Game for personal, non-commercial purposes. You may not copy, distribute, modify, or create derivative works based on Colobus without our prior written consent.

6. Third-Party Services

Colobus uses third-party services including PlayFab, Photon, and Unity. Your use of these services within the Game is also subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of these third-party services.

7. User Content

Any data, messages, or other content that you create or share through Colobus ("User Content") remains your responsibility. You grant Phoenic Analytics a worldwide, royalty-free, non-exclusive license to use, display, and distribute your User Content as necessary for operating and improving the Game. You must not upload or transmit any content that is unlawful, defamatory, or violates intellectual property rights.

8. Termination

We reserve the right to suspend or terminate your access to Colobus at any time, without notice, if you violate these Terms, abuse the service, or engage in conduct harmful to other players or the community. Upon termination, your right to use the Game will immediately cease.

9. Disclaimers

Colobus is provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not guarantee that the Game will be uninterrupted, error-free, or free from harmful components. Your use of the Game is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Phoenic Analytics and its affiliates, partners, or licensors shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of Colobus, including data loss, service interruptions, or unauthorized access.

11. Indemnification

You agree to indemnify, defend, and hold harmless Phoenic Analytics, its affiliates, employees, and partners from any claims, damages, liabilities, or expenses arising from your use of Colobus, violation of these Terms, or infringement of any rights of others.

12. Updates and Modifications

We may update or modify these Terms at any time. The “Last Updated” date at the top of this document indicates when these Terms were last changed. Continued use of Colobus after updates means you accept the revised Terms.

13. Unauthorized Copies & APK Distribution

You may not download, distribute, or promote unauthorized builds, cracked APKs, or repackaged versions of Colobus. This includes versions of the game that bypass authentication, modify gameplay, or remove these Terms.

Phoenic Analytics reserves the right to issue takedowns, file DMCA notices, and pursue legal action against unauthorized distribution, even on third-party platforms like Google Drive, MediaFire, or Discord. Phoenic Analytics may collect and retain IP addresses, account identifiers, and server logs for the purpose of investigating suspected violations and enforcing this Agreement.

14. Governing Law

These Terms are governed by the laws of Canada and the province of British Columbia, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in that province.

15. Third-Party Websites

The Game may contain links to third-party websites or services that are not owned or controlled by Phoenic Analytics. Phoenic Analytics has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Phoenic Analytics shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.
